Two Federal Labor Laws Revised in 2023 – New Workplace Posters Mandated

Often times businesses are informed of city, county or state labor laws that affect their workplaces. However, in 2023 two federal labor law revisions occurred requiring ALL employers to update their workplace labor law posters.

Effective April 28, 2023, the federal Department of Labor (DOL) revised its “Employee Rights Under the Fair Labor Standards Act” poster to include new legislation set forth in the Provide Urgent Maternal Protections for Nursing Mothers Act (PUMP). The new law extends the right to receive break time to pump and a private place to pump at work to more nursing employees.

Effective June 27, 2023, the federal Equal Employment Opportunity Commission (EEOC) updated its “Know Your Rights: Workplace Discrimination is Illegal” poster to include the new Pregnant Workers Fairness Act (PWFA). The new law requires covered employers to provide reasonable accommodations to a worker’s known limitations related to pregnancy, childbirth, or related medical conditions, unless the accommodation will cause the employer an undue hardship.

Both of these notices have mandatory posting requirements in all workplaces. Failure to post the newest version of these federal notices may result in costly fines and penalties.
