Labor Law Poster Alert: New Jersey Family Leave Act Poster Updated for 2026

September 28, 2026

New Jersey employers should review and update their workplace postings following significant changes to the New Jersey Family Leave Act (NJFLA). Effective July 17, 2026, New Jersey expanded job-protected leave eligibility, meaning more employers and employees are now covered by the NJFLA. The state has issued an updated Family Leave Act workplace poster reflecting these changes.

What Changed Under the New Jersey Family Leave Act?

Beginning July 17, 2026, New Jersey expanded the NJFLA in several significant ways:

Requirement Before Effective July 17, 2026
Employer size 30+ employees worldwide 15+ employees worldwide
Length of employment 12 months 3 months
Hours worked 1,000 hours in the previous 12 months 250 hours in the previous 12 months

State and local government agencies remain covered regardless of employee count.

Eligible employees may receive up to 12 weeks of job-protected leave during a 24-month period to bond with a new child or care for a family member with a serious health condition.

Why Does This Matter for New Jersey Employers?

New Jersey employers covered by the NJFLA are required to display the official New Jersey Family Leave Act workplace poster in a location that is easily visible and accessible to employees.

If your business has between 15 and 29 employees, this update is especially important to review. Your company may now be covered by the NJFLA even though it was previously below the employer-size threshold.

Is the New Jersey Family Leave Act Poster Required?

Yes. Employers covered by the New Jersey Family Leave Act must display the official Family Leave Act poster in a location that is easily visible to employees. Because the NJFLA eligibility requirements changed effective July 17, 2026, New Jersey has issued a revised Family Leave Act poster reflecting the new requirements. Employers should replace outdated versions with the current poster.

NJFLA Is Not the Same as Family Leave Insurance

One important distinction for employers is that job-protected leave and paid leave benefits are not the same thing.

The NJFLA provides eligible employees with job protection for qualifying family-related leave. New Jersey’s Family Leave Insurance (FLI), on the other hand, provides eligible workers with monetary benefits during qualifying leave.

New Jersey also expanded job protection for certain employees receiving Temporary Disability Insurance (TDI) or Family Leave Insurance benefits beginning July 17, 2026. This protection can apply when the leave is not already covered by the NJFLA or federal Family and Medical Leave Act (FMLA).

What Should New Jersey Employers Do Now?

Employers should take the following steps to help ensure their workplace remains compliant:

  1. Review your employee count

If your business has 15 or more employees worldwide, determine whether your company is now covered by the NJFLA.

  1. Display the new NJFLA poster

The updated poster is now available, and covered employers should replace outdated versions with the revised notice.

  1. Check all workplace locations

Display required labor law posters where employees can easily see and access them. If you operate multiple New Jersey locations, review postings at each location.

  1. Review your leave policies

Because eligibility requirements have changed, employers should review employee handbooks, leave policies, and internal HR procedures to ensure they align with current New Jersey requirements.

  1. Don’t forget remote and hybrid employees

Employers with remote or hybrid workforces should also review how required notices are made available to employees who do not regularly report to a physical workplace.

New Jersey employers should review their workplace postings and leave policies following the July 17, 2026 changes. With the NJFLA now covering more employers and employees, businesses that previously did not need to account for NJFLA coverage may now have additional compliance responsibilities.

The NJFLA update is just one example of why workplace poster compliance requires ongoing attention. New Jersey employers may be required to display multiple federal and state notices covering topics such as minimum wage, earned sick leave, family leave, unemployment and disability insurance, whistleblower protections, discrimination, and other employee rights.

Tracking individual poster changes can be difficult, especially for businesses operating in multiple states.

Make Workplace Poster Compliance Easier

Don’t wait for an outdated poster to become a compliance problem. Make sure your New Jersey workplace posters are current and properly displayed.
