Nevada Publishes Updated Rules to Be Observed by Employers Bulletin & New AB 190, AB 307 and SB 209 Notices

In July 2021, the Nevada Department of Business and Industry published an updated Rules to Be Observed by Employers Bulletin to announce an increase in minimum wage rates and update to leave of absence laws. New mandatory notices for Assembly Bills 190 and 307 as well as Senate Bill 209 were also published to announce revised leave of absence provisions and training notification requirements.

 Nevada Minimum Wage Law Update

  • Minimum wage increased to $8.75 per hour for employees provided qualifying health benefits and $9.75 per hour if no such health benefits are provided.

Wage and Hour Exemptions

Employees may be exempt from wage and hour laws based on criteria associated with their salary, actual duties, and skills. Exempt employees neither receive overtime pay nor qualify for minimum wage. Nevada Leave of Absence Law Updates

  • The Nevada Rules to be Observed by Employers Bulletin and SB 209 notice announce that employers must provide employees with 2-4 hours of paid leave to obtain a COVID-19 vaccination.
  • AB 109 explains that employees may use any accrued sick leave to assist a member of their immediate family who has an illness, injury, medical appointment or other authorized medical need to the same extent and under the same conditions the employee is permitted when taking such leave.

 Nevada Training Notice Update

  • AB 307 announces the Department of Employment, Training and Rehabilitation shall provide notices regarding job training or employment trainings including the Career Enhancement Program and Nevada JobConnect.

Nevada Labor Law Poster Update

All businesses within the State of Nevada must display the revised Rules to Be Observed by Employers Bulletin and new AB 190, AB 307 and SB 209 along with other state-mandated posting requirements where it is sufficiently accessible and viewable to all employees. This change has been reflected in our Nevada & Federal Labor Law Poster and does require an immediate mandatory update. Failure to meet compliance requirements and display the updated poster could result in fines.
