Minneapolis Implements New Sick and Safe Time Benefits

 

 

Beginning July 1, 2017 all employees who work within the Minneapolis city limits will begin to accrue sick and safe time hours.  These hours will be available for employees when they or a family member is sick, injured, needs preventive healthcare or needs to seek help for domestic violence, sexual assault and stalking and includes all related needs concerning these circumstances.

Who is Covered

As mentioned above, the law covers all workers within the city limits of Minneapolis.  This includes full-time, part-time, seasonal, paid interns and temporary workers.  The accrued hours are payable for companies with more than five (5) employees; however, for companies with five (5) or less employees, the employer has the discretion to provide the time paid or unpaid.  In all situations, employers may not retaliate against workers for using available time.

How Hours Are Accrued

 Beginning July 1, 2017, all existing employees will begin to accrue one (1) hour for every thirty (30) hours worked.  For all employees hired after July 1, 2017, accrual will begin on the employee’s first day of work.  At the employer’s discretion, they may allow the use of accrued hours during the first 90 days of employment; however, that is not a requirement.  Employees will accrue and carry over hours from year-to-year and can “bank” up to 80 accrued hours at any given time.  Individuals who are classified as “non-exempt” (meaning that by law they receive pay for all hours worked) will accrue Sick and Safe Time for all hours worked.

Posting Requirement

All businesses within Minneapolis must display the new Sick and Safe Time notice.

In addition, complete compliance requires that all businesses display specific state and federal labor compliance laws, all of which are available on the Minnesota All-in-One-Poster.
