State Mileage Reimbursement Delaware (DE) Employees

If you are an employee in the state of Delaware and have to travel for work, you may be interested to know that your employer does not have to pay you for your travel expenses. They are required to pay you for your travel time, but there is no law that states that they must pay a certain rate for miles traveled. Most employers will reimburse you for using a personal vehicle in the course of business. The rate at which most employers use for mileage costs is at or around the rate set by the IRS.

If your employer chooses not to reimburse you for the miles that you drive than you may claim it as a deduction. The current federal standard rate is $.445 per mile. If you are given a mileage rate and it is below this amount than you may be able to claim the difference, however if you are paid at a higher rate, the excess may be considered taxable wages.

Most employers have their own definitions of what constitutes a business travel expense and to what extent they are reimbursable, however the majority will allow for miles traveled, and if traveling for an extended period, meals and lodging.

The only exception is for claimants of Workers Compensation. Employers, or their insurance companies are required to pay for travel expenses of injured employees. The rate is currently $.40 per mile. The accounting division of the state department of finance determines this rate.

According to the statute, an employee shall be entitled to mileage reimbursement in an amount equal to the State of Delaware specified mileage allowance rate in effect at the time of travel. Travel to obtain reasonable surgical, medical, dental, optometric, chiropractic and hospital services is considered reimbursable. Employees have the right to be treated by the medical provider of their choice.
