California Workplace Discrimination and Harassment Law Updates

 

California legislature has made recent adjustments to the laws concerning time off for pregnancy and adoption as well as the law concerning discrimination based on sexual harassment and other gender related aspects.

Time Off for Birth and Adoption

The law has recently changed requiring employers to allow eligible employees to take up to 12 weeks leave in a 12 month period for the birth of a child or placement of a child in adoption or foster care.  Previously the law applied to employers with 50 or more employees, however, the recent change affects all employers with 20 or more employees.

Sexual Harassment and Other Gender Related Discrimination

Under the revised law, employers with 50 or more employers (as well as all public employers) are required to provide training to supervisors and managers regarding the prevention of sexual harassment, abusive conduct and harassment based on gender identity, gender expression and sexual orientation.

Posting Requirements

Both of these laws carry mandatory posting requirements and are reflected in the California Law Prohibits Workplace Discrimination and Harassment poster.
