In January 2022, the California Department of Fair Employment & Housing announced revisions to the Family Care & Medical Leave and Pregnancy Disability Leave, Pregnant Employee Rights and Obligations, and Workplace Discrimination and Harassment notices.

California Family Care & Medical Leave and Pregnancy Leave Law

  • Condensed wording to state “family” instead of specifying family members
  • Note referring to regulation codes has been deleted 

California Pregnant Employee Rights and Obligations

  • Definitions of “child” and “parent” added for clarification

California Workplace Discrimination & Harassment

  • Definitions of “child” and “parent” added for clarification
  • Clarification on how to file a complaint
  • Requirement of employers, employment agencies, and unions to preserve applications, personnel records, and employment referral records increased to four years.

California Labor Law Poster Update

All businesses within the State of California must display the new Family Care & Medical Leave and Pregnancy Disability Leave, Your Rights and Obligations as a Pregnant Employee, and Discrimination & Harassment notices along with other state-mandated posting requirements where it is sufficiently accessible and viewable to all employees. This change has been reflected in our California & Federal Labor Law Poster and does require an immediate mandatory update. Failure to meet compliance requirements and display the updated poster could result in fines.
