The Oregon Smokefree Workplace Law applies to employers across the state that operate their businesses from a workplace. The law is intended to protect employees from the damaging effects of secondhand smoke. According to the Law, employees should not smoke within an "enclosed area under the control of a public or private employer that employees frequent during the course of employment."
Employers should post a no smoking sign within the workplace in order to ensure that employees are aware of their rights. This signs should be displayed in an area that is visible to all employees, such as an employee break room. However, employees may smoke outside of the workplace in designated smoking areas that are away from windows and doors.
