In June 2022, the Oregon Bureau of Labor & Industries set forth increased minimum wage rates for 2022-2023 and revised labor law notices for Breaks & Overtime, Sexual Harassment & Domestic Violence Protections, and Agricultural Workers.

 Oregon Minimum Wage Law Update

  • Minimum wage increased to $13.50 per hour for standard counties; $14.75 per hour for the Portland metro area; $12.50 per hour for nonurban counties.
  • New rates are in effect from July 1, 2022 to June 30, 2023.

Wage and Hour Exemptions

Employees may be exempt from wage and hour laws based on criteria associated with their salary, actual duties, and skills. Exempt employees neither receive overtime pay nor qualify for minimum wage. Oregon labor law defines these exemptions based on Executive, Administrative, or Professional status. Learn more here.

Oregon Breaks & Overtime Law Update

  • Employees under the age of 18 are required to take two 15-minute breaks.

Oregon Sexual Harassment & Domestic Violence Law Update

  • Employers are required to keep all documents and information confidential.

Oregon Agricultural Workers Law Update

  • Agricultural workers must receive overtime for hours worked over 55 in a workweek effective January 1, 2023.
  • Minors under 18 years of age may work in non-hazardous farm jobs outside of school hours.
  • Minors 14-17 years of age who operate power driven farm machinery or ride in or on machinery must obtain a certificate of training.
  • Employers must obtain a permit to employ minors under the age of 14.

Oregon Labor Law Poster Update

All businesses within the State of Oregon must display the Minimum Wage, Breaks & Overtime, Sexual Harassment & Domestic Violence Protections, and  Agricultural Workers notices along with other state-mandated posting requirements where they are sufficiently accessible and viewable to all employees. This change has been reflected in our Oregon & Federal Labor Law Poster and does require an immediate mandatory update. Failure to meet compliance requirements and display the updated poster could result in fines.
