Virginia is one of 26 states which operate under OSHA approved state plans. As part of the state’s plan, violation penalties are reviewed annually and adjusted effective on August 1 of each year.
As a result, revised penalties have been posted and are effective August 1, 2017. Mandatory penalties against private sector employers are as follows:
- $12,471 for each serious violation
- $12,471 for each other than serious violation
- $12,471 per day for failure to correct violations within proposed time period
- $124,709 for willful repeated violations
