Nebraska ( NE ) Wage and Hour Laws

Nebraska (NE) wage and hour laws were written to establish a standard for all employees and employers. These laws serve as a guide for the entire state of Nebraska.

Nebraska (NE) wage and hour laws do not make a specific provision for minimum wage. Instead, they follow the federal standard for minimum wage, which is currently set at $5.15 per hour. This applies to employers who have four or more people working for them. The minimum wage for tipped employees is $2.13 per hour.

There have been some efforts being made to increase the minimum wage in Nebraska to $6.26 per hour. There also have been some efforts being made to raise the federal minimum wage as well, to $7.25 per hour. If there is a discrepancy the higher minimum wage must be paid.

Certain exceptions regarding the payment of minimum wage exist within the wage and hour laws that Nebraska follows. For example, some workers with disabilities receive their own special rate of pay. Those who are disabled must have a disability that affects their work enough that it causes them to perform at a below average rate.

Nebraska (NE) wage and hour laws state that workers who put in more than 40 hours in one 7-day work week must be paid overtime one-and-a-half times the regular work wage for those extra hours. The hours that count towards overtime must be actual hours worked, and not hours paid for vacations, holidays, or other time off. Some employers are exempt from paying overtime. For example, small businesses with revenue under $500,000 are not required to pay overtime wages to their workers.

Nebraska (NE) wage and hour laws have specific provisions regarding breaks. For instance, those who work eight or more hours in a row are entitled to a 30 minute meal break. In addition, this meal break must be uninterrupted and the employee must be allowed to leave the premises. These breaks are only mandatory for those working in certain industries such as assembling plants or mechanical establishments.
