Breast feeding provides benefits to both mother and baby, and is recommended by health professionals as the ideal method of feeding infants. Although the CDC estimates that 76% of new mothers start off breastfeeding their newborns, during the first 6 months of the child’s life this number drops to 16%. Often, this is directly related to the difficulty working mothers face when they attempt to continue breastfeeding after returning to work. Several laws have been enacted to address this issue and many employers are now required to accommodate nursing mothers.

Organizations subject to the Fair Labor Standards Act (FLSA), which includes almost every employer, are required to provide nursing mothers with adequate breaks to express breast milk for up to a year after the child’s birth. And over half of the states have additional requirements.

Some employees, like many employers, may not yet be aware of their legal rights. Nevertheless, employers who do not adhere to the regulations are at risk of being sued on the grounds of lactation discrimination.
