The Wyoming Department of Workforce Services has released a new workplace poster in response to the new non-compete law, which takes effect on July 1, 2025, and voids most non-compete agreements entered into on or after that date.
Key Provisions of the Wyoming Non-Compete Ban
- Wyoming Governor Mark Gordon signed Senate Bill 107 into law on March 19, 2025.
- Starting July 1, 2025, most new non-compete covenants that restrict an individual’s right to earn compensation via skilled or unskilled labor will be void and unenforceable.
- Exceptions are permitted for agreements related to the sale of a business, trade secret protection, recovery of training and relocation expenses, and agreements with executive-level personnel.
- There is a special rule for physicians that voids some restrictions on their practice after their employment is terminated.
- The law is not retroactive. Non-compete agreements entered into before July 1, 2025, remain valid under their original terms.
The New Non-Compete Workplace Poster Requirements
To support awareness of the new law, the Wyoming Department of Workforce Services issued a mandatory “Non-Compete Clauses” poster that must be displayed in the workplace. Labor Law Center, an OutSolve Company, has already updated its Wyoming Labor Law Poster to satisfy the new requirement.
This means, in addition to the usual state and federal labor law postings, employers must now ensure that the new non-compete notice is posted in a conspicuous location that is accessible to employees.
Penalties for Non-Compliance
Posting the new “Non-Compete Clauses” notice is legally required. If you use a combined state and federal labor law poster, the new notice must be included. Displaying an outdated poster can lead to fines and costly legal issues. Additionally, ensuring employees have the most current information about labor laws is simply good business practice.
Action Steps for Wyoming Employers
- Review: Audit existing employment agreements and contracts to ensure compliance with the new law.
- Identify Exceptions: Consider company positions that may legitimately fall under permissible exceptions and update contract or policy language as needed.
- Display: Ensure you have the new “Non-Compete Clauses” notice and post it prominently in the workplace.
