In January 2023, the Colorado Department of Labor and Employment published a new Family and Medical Leave Insurance (FAMLI) Program Notice and a revised Overtime and Minimum Pay Standards Order.
Colorado Family and Medical Leave Insurance (FAMLI) Program Notice
- New notice informs employees of the FAMLI program
- Employee share of FAMLI premiums set at 0.45% through 2024
- Starting January 1, 2024, paid family and medical leave benefits will be available for most Colorado employees who have a qualifying condition and meet compensation requirements
- Information regarding filing claims, job protection and continuation, and prohibited retaliation, discrimination, and interference provided
Colorado Minimum Wage Law Update
- Minimum wage increased to $13.65 per hour; $10.63 per hour for tipped employees
- Additional information about tip credits and exemptions from COMPS
- New rates effective January 1, 2023
Wage and Hour Exemptions
Employees may be exempt from wage and hour laws based on criteria associated with their salary, actual duties, and skills. Exempt employees neither receive overtime pay nor qualify for minimum wage. Colorado labor law defines these exemptions based on Executive, Administrative, or Professional status. Learn more here.

Federal EEOC Workplace Discrimination Law Update
