As an employer in the healthcare field, both federal and state law require that you display posters informing your employees of the laws that protect them as laborers. These posters must be displayed clearly in a private family clinic, a dental health office, an optometry office, a nursing home, a rehabilitation center, or any other healthcare facility that has one or more employees. Labor law posters must be displayed in a place where your employees regularly visit, such as a break room or team meeting room. The information on these posters informs your employees of their rights, as well as the requirements placed on you as a hiring body. Having the posters in place ensures that everyone is on the same page.
Standard Posters
For the most part, you will need the same set of standard posters as most other employers. These include:
- An Equal Employment Opportunity poster, which informs applicants that you abide by non-discrimination laws when it comes to hiring.
- An Occupational Safety and Health Act poster, which informs employees of the protection they have in the event of a workplace accident.
- A Fair Labor Standards Act poster, which informs employees that you abide by the current minimum wage standards. It also informs employees with disabilities of the conditions under which special minimum wage is paid.
- A Family and Medical Leave Act poster, informing employees of their rights under the act, and how to file a complaint if their rights have been violated.
- A Union Member Rights poster, from the Department of Labor’s Office of Labor-Management Standards. This poster informs union employees of their rights and responsibilities.
- A Uniformed Services Employment and Reemployment Rights Act poster, which informs employees who are in the military of their rights at their civilian job.
- An Employee Polygraph Protection Act poster, which informs employees of the prohibition of required lie detector screenings before, during, or after their employement.
Federal Contractors
If your healthcare facility is a federally contracted facility, such as a hospital that provides care to veterans, you will also need to display the posters that are specific to federal contractors In addition to the labor law posters listed above, these include:
- An Service Contract Act/Walsh-Healey Poster poster, which establishes the federal minimum wage requirements, and informs employees of their benefits and rights as a federal employee.
- A National Labor Relations Act Notice, which informs federal employees of certain rights, such as the ability to form a union.
- An E-Verify poster, which is only necessary if your business uses the E-Verify system to determine the eligibility of employees.
- A Right to Work Notice, which informs employees of their right to work without being hindered by unfair union laws, or other conditions.
If your work force is comprised of at least 20% Spanish-speaking employees, you must post all the labor law posters in both English and Spanish. Some states, such as California, Texas, Arizona, and New York require this no matter what. This ensures that all your employees are fully informed of their rights and responsibilities under the law.
