Do My Labor Law Posters Need to Be in Spanish?

There are over 40 million Spanish speakers in the United States, as of the 2016 Census. As a business owner, there is growing probability that you will employ Spanish speakers. Do you need to get all of your labor law posters in Spanish as well? The short answer: it depends.

With a few exceptions, Family Medical Leave Act (FMLA), The Migrant and Seasonal Agricultural Worker Protection Act (MSPA) and Executive Order 13496, the U.S. Department of Labor’s federal regulations don’t require posting of notices in Spanish or other languages.  

General Practice

For the FMLA, MSPA, Exec Order 13496, Federal law states that if you have a lot of Spanish-speaking employees, you must post the Federal FMLA poster in Spanish as well as English. The definition of “a lot” is up to interpretation but the common practice is that if you have 10% or more Spanish-speaking employees, you should get the posters.

Location

There may be others requirements are just based on location. Currently, five states (Arizona, California, Florida, Texas, and New York) recommend postings in both English and Spanish.
