North Dakota ( ND ) Wage and Hour Laws

North Dakota (ND) wage and hour laws are designed to establish as fair of working conditions as possible. These laws also serve as a guide for employers located within the state of North Dakota.

According to North Dakota (ND) wage and hour laws, the current state minimum wage for employees is $5.15 per hour. It will soon rise to $6.75 per hour as of October 2006. Tipped employee’s wages equal a minimum of $3.45 per hour, and the maximum tip credit is 33%. The wage paid per hour to North Dakota workers could rise in the near future, and the following paragraph explains one reason why.

If the federal government rules to increase the minimum wage it will first rise to $5.85 per hour, then it will rise to $6.55 per hour. Finally, it will rise to $7.25 per hour. If the federal government rules to increase minimum wage and North Dakota have not increased theirs by the time the federal government does, employers will have to comply with the federal standard for minimum wage paid to workers.

Overtime is paid to most North Dakota employees for any hours worked over 40 per week, at a rate of one and a half times their regular hourly wage. Some exceptions apply to this, however. For instance, taxicab drivers who work in North Dakota are paid overtime after 50 hours a week.

North Dakota (ND) wage and hour laws also state that those who work in a hospital or residential institutions are usually paid overtime based on a 14-day pay period. Employees such as executives and foster care workers also are exempt from receiving overtime pay.

Along with all of the above, North Dakota (ND) wage and hour laws have provisions written in them regarding employee breaks. For example, the state of North Dakota requires employees to receive an unpaid break of 30 minutes if they work at least 5 hours in a row.

According to North Dakota (ND) wage and hour laws employees whose breaks are not paid for by their employers must be completely free of all their duties. Employees must be paid for this break even if they do small tasks during this time, such as answer phones.
