Displaced Employee Rights

The Displaced Employee Rights poster provides explanation of the Executive Order (E.O.) 13495, “Non displacement of Qualified Workers Under Service Contracts,” which was signed by President Obama on January 30, 2009. This order applies to federal government service contracts and the hiring of new contractors. The order stipulates that qualified workers who would possibly lose their jobs as a result of the completion or expiration of a contract be given the right of first refusal for employment with the new contractor. In general, it states that a new contractor not hire any new employees until the current employees refuse continued employment.

The Executive Order also includes a number of exclusions from the non displacement requirements, which are explained in detail on the Displaced Employee Rights poster.

It is of the upmost importance that employees know their right in this matter of federal contracts. As a result, the Executive Order requires the contractor to either post a notice (such as this poster) or give individual notice to the employees of this obligation.
