It is essential that final warnings be documented to protect the employer from potential disgruntled employee disputes and or lawsuits. An employer without proper documentation may be forced to rehire the employee, and even pay back wages, penalties and punitive damages. Final warnings that are in writing can also help prevent frivolous unemployment claims.

The Final Warning Notice indicates that the employee understands the gravity of the situation. It clearly states that the worker realizes that he or she may be terminated if the offense is repeated. The form gives employees the option to resign immediately or agree to an action plan to improve their performance.
