According to the ADA, employers should make reasonable accommodations for employees with disabilities. These accommodations should help employees to perform the functions of their jobs more easily or comfortably. For example, if an employee is bound to a wheelchair, the employee may request that the employer provide the employee with a lower work station with enough space to accommodate the wheelchair.

 

When an employee makes an Accommodation Request, the employer should respond to the request in a timely manner. This Accommodation Response Form should be given to employees with more information about whether the employee’s accommodation request has been approved or denied. The Accommodation Response Form requires employers to state when the Accommodation Request was submitted as well as more information about the employer’s decision to approve or deny the request.

 

In some cases, an employer may approve an Accommodation Request, but with modifications. In such a situation, the employer can provide an explanation of how the request will be modified. The employer should also provide the date for when the accommodation request will be installed and for how long it will stay in place.

 

If the Accommodation Request is denied, the employer should check off why the request was denied. If the request was denied because it would provide the employer undue financial hardship, then the employer must state the cost of the Accommodation that was denied.

Who is Covered by the ADA

The ADA applies to:
  • Private sector employers with at least 15 employees
  • Employment agencies
  • Labor organizations
  • Joint labor/management committees
  • State, local, and federal government entities
All employees and job applicants are covered if they work for, have worked for, or are applying to work for a covered employer. In order for individuals to be covered, they need to have a qualifying disability, which often includes a recognized physical disability.
