According to the ADA, employers should make reasonable accommodations for employees with disabilities. These accommodations should help employees to perform the functions of their jobs more easily and comfortably. For example, if an employee is bound to a wheelchair, the employee may request that the employee provide a lower work station with enough space to accommodate the wheelchair.

 

In order to make an Accommodation Request, employees should submit a formal request to the employer. The Accommodation Request Form requires employees to submit information regarding their name, department, employee ID or Social Security Number, and job title. Employees should also describe their Accommodation Request and the reason for it.

 

Employees will be required to provide a description of their disabilities and how that disability impacts their ability to perform major life activities. Employees should also explain how that disability impacts the employee’s ability to perform the basic functions of the job.

 

Many employees have an idea for an accommodation in mind. If the employee has a suggested accommodation, the employee may describe that suggestion in detail. If the employee does not have a suggestion for an accommodation, then the employee can explain why he or she requires some assistance. The employee should also indicate a time period for instituting the accommodation, if one applies.

 

Who is Covered by the ADA

The ADA applies to:
  • Private sector employers with at least 15 employees
  • Employment agencies
  • Labor organizations
  • Joint labor/management committees
  • State, local, and federal government entities 

All employees and job applicants are covered if they work for, have worked for, or are applying to work for a covered employer. In order for individuals to be covered, they need to have a qualifying disability, which often includes a recognized physical disability.

 

Document all correspondences/responses pertaining to such a leave.  It’s a highly recommend method to prevent potential legal issues.
