The West Virginia minimum wage is $7.25 per hour, with overtime required after 40 hours. It applies to employers with 6 or more workers at a single location. However, some employers covered by the federal Fair Labor Standards Act or FLSA may legally pay only $6.55 per hour, because they are specifically excluded from the West Virginia minimum wage law. The Nurses Overtime and Safety act limits the amount of overtime that nurses can be required to work. Employers can make overtime mandatory for employees in all other occupations.*
