New York ( NY ) Labor Law Quick Facts:
New York employers are required to notify all new hires of their wages, hours and benefits. The minimum wage is $7.25, or $4.75 for tipped employees in restaurants. New York requires that nonexempt employees be paid on an hourly basis - only exempt employees can be paid a salary. Many employers, including restaurants and hotels, must pay workers a premium equal to one hour's wages when the employee works more than 10 hours per day. However, this "spread of hours" pay is not counted towards overtime. An employer cannot discriminate in hiring against an employee with a felony conviction for an offense unrelated to the job.*
