Labor Law Quick Facts:
The South Dakota minimum wage is $5.85 per hour, $2.13
for tipped employees. Most employees are entitled to
overtime after 40 hours under federal, not state, law.
The state does not require any work permits for minors.
However, young people under the age of 16 are not permitted
to work more than 4 hours on a school day, or more than
20 hours per week when school is in session. There is
no state family leave law, but most employees are entitled
to 12 weeks of unpaid, job-protected leave under the
federal FMLA.*
