Attendance Folder
Every employer is entitled to establish its own attendance policies for its employees. However, employers should keep track of employees' attendance in order to be sure that employees are eligible for certain attendance-related benefits and coverage under many federal and state acts, such as the Family and Medical Leave Act.

Why the Attendance Folder is important

The attendance folder helps employers to stay organized and informed about their employees’ attendance records. These attendance records may perform the following functions:

  • Provide proof that employees are eligible for some government benefits and coverage
  • Ensure that employees are not over-using their vacation days

  • Create a record that may be part of a performance evaluation or separation review

Employers should keep information pertaining to an employee’s attendance for at least two years, as employees have up to two years (in most states) to file a lawsuit against an employer for reasons such as wrongful termination or discrimination. However, if attendance is related to an employee’s payroll or taxes, the employer should maintain records for at least seven years and may need to provide these records in the event that the employer or employee is audited.
