Labor Law Quick Facts:
The North Dakota minimum wage is $5.85 per hour ($3.92
for tipped employees), with overtime after 40 hours.
Employees are entitled to a 30 minute unpaid break on
any shift of 5 hours or more. The Human Rights Division
of the North Dakota Department of Labor enforces state
regulations against discrimination based on race, color,
religion, sex, pregnancy, marital status, age, receiving
public assistance and lawful activity outside the workplace.
Youths who are 14 or 15 years old require work permits.*
